
TRUE REWARDS - OFFICIAL RULES

Participation in the True Rewards Program is subject to creation of a True Rewards account and the following Terms and Conditions. Your participation in the True Rewards Program will be governed by these Terms and Conditions. By enrolling, creating an account, or using the True Rewards Program, you acknowledge, accept and agree to the True Rewards Program Terms and Conditions. A guest's participation in the True Rewards Program acknowledges their agreement to abide by these Terms and Conditions.
IMPORTANT: SECTION 37 OF THESE TERMS AND CONDITIONS CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER, WHICH MAY REQUIRE YOU AND US TO RESOLVE DISPUTES IN BINDING, INDIVIDUAL ARBITRATION, AND NOT IN COURT. FOR COMPLETE TERMS AND CONDITIONS THAT BIND YOU AND US, PLEASE REFER TO THE "DISPUTE RESOLUTION" SECTION OF THIS DOCUMENT.
1. Guests must be at least 21 years of age to join the True Rewards Program ("True Rewards") and must present an acceptable, valid, state or government issued photo ID for registration. Acceptable forms of photo identification include: State issued driver's license, State issued ID card, government issued passport for non-U.S. residents, Military ID or a government issued green card. Golden Entertainment, Inc. (the "Company") will determine what is an acceptable form of identification.
2. Eligible Guests can enroll in True Rewards at True Rewards counter locations at Golden Casino locations, with Bar Host at Golden Tavern locations and on the True Rewards mobile application. True Rewards membership enrollment must be activated by presenting a valid government issued photo identification at a True Rewards counter location.
3. Only individuals may enroll in True Rewards as members. Eligible individuals may enroll, including employees eligible under Golden team member rules, and their family members may enroll if otherwise eligible under the Terms and Conditions.
4. The benefits of the True Rewards Program are intended for use only by the person listed on the account. Only the person listed on the account may use the account for benefits associated with the True Rewards Program. Teams or multiple individuals playing on one account is strictly prohibited and may result in loss of True Rewards privileges.
5. True Rewards cards and accounts are non-transferable and are the property of the Company and must be returned upon the Company's request.
6. Only the member listed on a True Rewards account may receive account information or engage in any transactions related to their True Rewards account.
7. True Rewards accounts and all associated benefits are non-transferable, including upon death, domestic relations matters, divorce or by operation of law.
8. Guest is responsible for selecting a Personal Identification Number (PIN) for their True Rewards account and for keeping this PIN and their log in credentials confidential and secure. Guest is responsible for any activity on their True Rewards account.
9. A member is required to provide valid, government issued photo identification with the same name that is on the True Rewards card when requesting that their PIN be changed or reset.
10. The member may not sell, transfer, purchase, trade or barter True Rewards cards or any other membership benefit to another person.
11. The Company is not responsible for lost, damaged or stolen True Rewards cards, including any misuse of True Reward card or True Reward account.
12. It is the 'True Rewards member's responsibility to ensure that their True Rewards card is properly inserted into a machine to track play. The Company is not responsible for any machine or card reader error.
13. True Rewards points are earned by guests at participating locations in accordance with their gaming and participating retail purchase activity. The number of True Rewards points earned will vary depending on the type of gaming device played. Base points are awarded for all tracked slot, keno, bingo, poker, table game play and retail purchases, where applicable. The Company may revise the method for earning points at its discretion.
The current schedule for earning points is as follows:
- Earn one (1) base point for every $1 of coin-in on designated video reel, video keno and reel slot machines at casino locations
- Earn one (1) base point for every $2 of coin-in on designated video poker, video keno and multigame machines at participating tavern locations
- Earn one (1) base point for every $2 of coin-in on designated video poker and video blackjack machines at casino locations
- Earn one (1) base point for every $4-$8 of coin-in on designated full pay video poker machines (based on type of machine and casino location)
- Earn three (3) base points for every $2 buy-in at bingo at participating casinos
- Earn eight (8) base points for every $1 buy-in at live keno at participating casinos
- Earn base points playing table games based on type of game, average bet and amount of time played at participating casinos
- Earn fifteen (15) base points for every $1 you spend in participating casino bars and restaurants cash or credit card sales, not including tax or gratuity

14. In order to be evaluated for points for table play at casinos, guests must present their True Rewards card to the table game's supervisor before a wager is placed. Members must meet minimum betting requirements to earn points for table game play. Member may speak with a table games supervisor for specific information on such requirements.
15. Base points are the points earned on an actual play of games independent of any type of promotional offer.
16. True Reward points may be redeemed for slot play, cash back or dining at participating bars and restaurants and retail vendors. At taverns, points may only be redeemed for slot play.
17. Points may be redeemed for casino slot play or table games promo chips (500 points = $1 slot play or promo chip). A minimum of $5 slot play or promo chips must be redeemed at any given time at Arizona Charlie's Decatur, Arizona Charlie's Boulder, Aquarius Casino Resort, Edgewater Casino Resort, and The STRAT Hotel, Casino & Tower. Promotional chips are not offered for point redemption at Arizona Charlie's Boulder, Pahrump Nugget, Gold Town Casino, or Lakeside Casino.
18. Points may be redeemed for tavern slot play (1,000 points = $1 slot play).
19. Points may be redeemed for complimentaries at participating casinos (300 points = $1 comp). Redeem points for complimentaries at participating taverns (1,000 points = $1 comp).
20. Points may be redeemed for cash back (1,000 points = $1 cash) ($1 minimum/$3,000 daily limit) at participating locations.
21. All True Rewards point accumulations are subject to review and verification by the Company. The Company reserves the right to adjust account status due to computer error, machine malfunction, operator error, fraud or other misuse of the True Rewards card or benefits.
22. True Rewards tier status is based on the number of True Rewards base points (non-promotion points) earned from January-December at casino locations. Earning period for Tavern locations is January-June or July-December.
23. Tier qualifying thresholds and time requirements are available at the True Rewards Center, truerewards.com and the True Rewards mobile application.
24. Additional benefits earned through tier achievement may be modified, changed, added, deleted, or canceled by the Company at its discretion. These may be found on True Rewards website : truerewards.com.
25. Points and Tier benefits are valid as long as a minimum of one (1) True Rewards point is earned every thirteen (13) months. If no True Rewards point is earned within a thirteen (13) month period, True Rewards benefits will expire.
26. PT's Taverns comp dollars earned will expire 90 days from date earned.
27. A valid photo ID is required for redemption of any benefit earned through True Rewards. Photo ID must match the name on any coupon or voucher.
28. Any and all applicable taxes related to the receipt of benefits are the sole responsibility of the True Rewards member.
29. All benefit redemptions are final. Any exceptions must be pre-approved by Company management.
30. Individuals who are excluded, suspended or in collections, trespassed and/or banned from Company properties, including through a government program, by their own request and/or at the discretion of the Company, are not eligible to participate in the True Rewards program. If an individual is excluded, in collections, trespassed and/or banned from Company properties, the point balance on the individual's account will be deleted and the account closed, and the guest will NOT receive remaining benefits on their account.
31. True Rewards members acknowledge and agree by signing up for a True Rewards Account to allow the Company use of their name and likeness for promotions and announcements without compensation, consideration, notice, review, or further consent.
32. The Company reserves the right to deny participation in the True Rewards program, or to terminate a True Rewards account at any time, subject to applicable gaming laws.
33. The Company reserves all rights pertaining to the True Rewards program, including regarding the interpretation of rules, eligibility, etc. for the True Rewards program. The Company also reserves the right to void and/or change, cancel or modify the program at any time and/or for any reason, including but not limited to as necessary to comply with applicable state and federal laws and regulations.
34. The Company reserves the right to adjust points inaccurately awarded due to machine malfunctions or configuration errors.
35. The Company maintains a privacy policy that governs the Company's use of its members' information. A copy of the privacy policy is incorporated into these Terms and Conditions available on the Company website (truerewards.com) and at the True Rewards Center. By agreeing to these Terms and Conditions, you also agree to the privacy policy.
36. Participating locations include: The STRAT Hotel, Casino & Tower (TheSTRAT.com),PT's Taverns (ptstaverns.com),Pahrump Nugget (pahrumpnugget.com),Gold Town Casino (gtowncasino.com),Lakeside Casino (lakesidecasinopahrump.com),Arizona Charlie's Decatur (arizonacharliesdecatur.com),Arizona Charlie's Boulder (arizonacharliesboulder.com),Aquarius Casino Resort (aquariuscasinoresort.com) and Edgewater Casino Resort (edgewater-casino.com).
37. DISPUTE RESOLUTION
PLEASE READ THIS SECTION CAREFULLY. IT MAY AFFECT YOUR RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
The terms of this Section 37 apply to all Disputes even if the events or relationships giving rise to such Dispute occurred before this version of the Terms and Conditions (or such modification). However, if you or we initiated an arbitration or lawsuit prior to this version of the Terms and Conditions (or such modification),that matter will continue to be governed by the version of the Terms and Conditions applicable when the arbitration or lawsuit was initiated. If any provision in this Section 37 is deemed to be unlawful, void or for any reason unenforceable, that provision shall be severed with the rest of Section 37 of these Terms and Conditions remaining in full force and effect. Each provision of this Section 37 applies to the maximum extent permitted by law whether or not so expressly stated.
A. Binding Arbitration and Class Action Waiver.
You and we agree that this agreement evidences a transaction in interstate commerce and that the Federal Arbitration Act (9 U.S.C. § 1, et seq.) applies. You and we agree to submit all Disputes between us to individual, binding arbitration under the provisions in this Section 37. A "Dispute" means any dispute, claim or controversy (except those specifically exempted below) between you and us that in any way arises out of, relates to or is connected with your use or attempted use of the True Rewards Program, all marketing for the Program, your True Rewards account, these Terms and Conditions, the Privacy Policy, or any other agreement between you and us, including any disputes over the validity or enforceability of this agreement to arbitrate. You and we understand that there is no judge or jury in arbitration and that court review of an arbitration award may be limited.
i. Binding Arbitration. If a Dispute cannot be resolved through informal negotiations, then either party may initiate binding arbitration as the sole means to formally resolve the Dispute unless an exception applies as stated below. The arbitration will be administered by the American Arbitration Association ("AAA") in accordance with the AAA Consumer Arbitration Rules, as modified by this agreement. The AAA Rules are available at the AAA's website, https://www.adr.org. If your Dispute involves claims similar to those of at least 24 other customers, and if you and those other customers are represented by the same lawyers, or by lawyers who are coordinating with each other, you and we agree that these claims will be "Related Cases." Related Cases will be governed by the AAA's Mass Arbitration Supplementary Rules, as modified by this agreement. For more information, see https://www.adr.org/mass-arbitration. The arbitrator must follow applicable law. The decision of the arbitrator shall be final and binding on you and us, and any award of the arbitrator may be entered in any court of competent jurisdiction. The arbitrator shall determine the scope and enforceability of this arbitration agreement, including whether a Dispute is subject to arbitration. The arbitrator has authority to decide all issues of validity, enforceability or arbitrability, including, but not limited to, where a party raises as a defense to arbitration that the claims in question are exempted from the arbitration requirement or that any portion of this agreement is not enforceable. If a lawsuit filed in court includes claims or requests for relief that are arbitrable and claims or requests for relief that are not, you and we agree that any non-arbitrable claims or requests for relief shall be stayed pending the completion of the arbitration of the arbitrable claims or requests for relief.
ii.Class and Collective Action Waiver. TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, YOU AND WE AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER PARTY ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A CLASS ACTION, COLLECTIVE ACTION OR CLASS ARBITRATION.
iii. Claims Exempt from Arbitration. Notwithstanding the parties' decision to resolve all Disputes through arbitration, either party may bring an action in state or federal court that only asserts claims for patent infringement or invalidity, copyright infringement, piracy, moral rights violations, trademark infringement, and/or trade secret misappropriation ("Excluded IP Claims"). Excluded IP Claims are subject to the jurisdiction provisions in Section 37(B) below. Notwithstanding the parties' decision to resolve all Disputes through arbitration, either party also may seek relief in a small claims court for any individual disputes or claims within the scope of that court's jurisdiction.
iv. 30 Day Right to Opt Out. You have the right to opt out and not be bound by the Binding Arbitration and Class Action Waiver provisions in this Section 37(A) by sending written notice of your decision to opt out to the following email address: [email protected], using the subject line "Arbitration Opt-Out." The notice must be sent within 30 days of the date on which you create your True Rewards account (or if you already had a True Rewards account at the time this version of the Terms and Conditions became effective, then within 30 days following the effective date); otherwise you shall be bound to arbitrate disputes in accordance with the terms of this Section 37(A). If you opt out of these arbitration provisions, we also will not be bound by them. Opting out of arbitration will not affect in any way the Program benefits to which you would otherwise be entitled.
v. Survival. The Binding Arbitration and Class Action Waiver provisions in Section 37(A) shall survive termination of the Terms and Conditions and/or your participation in the Program.
B. Venue and Jurisdiction.
To the fullest extent permitted by law, the state and federal courts of Clark County, Nevada shall have exclusive jurisdiction over any claims that are not subject to arbitration (except for claims in small claims court, which may be heard in any county in which you reside). You and we consent to the jurisdiction of those courts and waive any objection as to personal jurisdiction or as to the laying of venue in such courts due to inconvenient forum or any other basis to seek to transfer or change venue.
38. Golden Entertainment properties is not responsible for any human or other error, computer or other technical malfunctions, lost or delayed data or transmission, omission, interruption, deletion, defect, failures of any software or any other error or malfunction, including (without limitation) lost, interrupted, inaccessible or unavailable networks, servers, Internet service providers, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed or misdirected computer, cable or telephone transmission; or for any technical malfunctions, failures, difficulties, or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.
39. The Company reserves all rights, as allowed by applicable laws and regulations.
